1Your first and primary concern will be to check and make sure that both you and your passengers are ok. Call 911 immediately, even if no one appears to be visibly injured – everyone responds to an accident differently, and some injuries or symptoms are only obvious later. If you are taken to the hospital, be sure to make note of as many details as possible – such as the license place number of the other vehicle, the number of passengers in their car, and whether or not there are any witnesses that are willing to provide details.
2 Be aware of your surroundings. Get out of traffic to avoid further accidents and injuries. Make note of everything you see, including the license plate number of the other vehicle(s), skid marks, broken glass and car parts. If possible, photograph the scene – this could be important evidence for a police investigation and for your subsequent claim. There is no such thing as too much detail.
3 Exchange information with the other driver(s) involved, but do not discuss the accident with them. Be sure to ask for their name, address, phone number, insurance company, policy number and the name of their agent.
If there are witnesses, get their contact information as well. If someone saw the accident, their testimony could be invaluable to your case.
4 Tell the investigating officer everything, but do not admit fault. Even if you believe you may be responsible for the accident, an investigation may show that you were not. Admitting fault may change the course of the investigation, and not in your favor.
Be careful of statements that you make to the officer at the scene as they could harm your claim in the future – this includes statements like : I am fine. An officer may shorten the investigation if you give them any indication that the accident was not as serious as it may have actually been.
5 Be your own investigator – photograph everything. Put your smartphone to work and capture everything you can : the scene, damage to vehicles, road conditions, the other people involved in the accident and any other factors that might have influenced the accident.
Write down everything you remember, as soon as possible. After the trauma of an accident, you may think you will remember every detail – but the opposite is true. Cases can take weeks, months or even years to resolve and by that time, details can be difficult to recall.
6 Document you injuries. Even if you believe you were not injured in the accident, keep a journal of any pain or discomfort you experience in the days that follow as some symptoms may not present right away. If you were injured, this documentation will help support your claim.
For example : ‘May 02, 2020 I had trouble sleeping because of pain in my lower back. I could not get out of bed without the help of my spouse.’ Include any witnesses to your pain or limitations with your daily life. This could include a spouse, family, and co-workers. Keep a photo-log of all visible injuries.
7 Find an experienced injury attorney. It is important to find an attorney that not only understands how to build a strong case, but also one that is prepared to go to court if justice demands it.
